This Acceptable Use & Anti-Spam Policy (โAUPโ) is part of, and incorporated by reference into, our Terms of Service. It applies to anyone who accesses bettercallaxel.com or app.bettercallaxel.com (the โServiceโ) and to anyone who subscribes to a BCA newsletter, opt-in list, or transactional email channel.
Capitalized terms not defined here have the meaning given in the Terms.
Part A โ Acceptable Use of the Service
You may not use the Service, or allow anyone else to use it, to do any of the following:
1. Illegal or harmful conduct
- Violate any law, regulation, treaty, court order, or third-party right anywhere in the world.
- Evade taxes, sanctions, anti-money-laundering (AML) rules, know-your-customer (KYC) rules, anti-bribery laws (FCPA, UK Bribery Act), export-control rules (EAR, ITAR), or beneficial-ownership reporting requirements.
- Conceal beneficial ownership, layer transactions, or structure activity to avoid regulatory thresholds.
- Engage in fraud, forgery, identity theft, or impersonation.
2. Sanctions, embargoes, prohibited persons
You represent and warrant that you are not, and that you do not act on behalf of any person or entity that is:
- listed on the U.S. OFAC SDN List, EU Consolidated Sanctions List, UK OFSI list, or any equivalent list;
- located, organized, or resident in Cuba, Iran, North Korea, Syria, the Crimea / Donetsk / Luhansk / Kherson / Zaporizhzhia regions of Ukraine, or any other comprehensively sanctioned jurisdiction;
- a Specially Designated National, Russian-government-controlled entity, or otherwise barred from receiving services under U.S. or EU sanctions.
If your status changes after onboarding, you must notify us immediately at [email protected]. We will terminate the engagement and may report the matter as required by law.
3. Abuse of the Service
- Reverse-engineer, decompile, scrape, crawl, or systematically extract data from the Service.
- Probe, scan, or test the vulnerability of the Service, or breach security or authentication.
- Use the Service to train competing AI models, build a competing product, or benchmark against us for public comparison.
- Use the Service to send unsolicited marketing communications (see Part B below).
- Resell, sublicense, white-label, or grant third-party access to the Service without written consent.
- Submit malware, ransomware, viruses, worms, trojans, or any code intended to damage or interfere with any system.
- Post, transmit, or host material that is defamatory, harassing, threatening, hateful, sexually explicit involving minors, or that infringes intellectual-property rights.
4. Misuse of BCA-formed entities and BCA-administered accounts
LLCs we form for you, EINs we obtain, bank accounts we help you open, and real estate we sub-lease through BCAX may not be used:
- as a shell to evade taxes, sanctions, or judgments owed in any jurisdiction;
- to receive proceeds of crime, fraud, or unauthorized activity;
- to operate a business that we have not been informed about (e.g. adult content, regulated gambling, weapons, unregistered securities, unregistered money services, controlled substances, multi-level-marketing pyramid schemes, โguruโ / fake-financial-coaching content);
- in a manner inconsistent with the LLCโs stated purpose on its formation documents and tax filings.
We reserve the right to freeze, terminate, or report any account we reasonably believe is being used in violation of this Section 4 โ without refund and without prior notice.
5. Misrepresentation and reputation
- Do not publicly mis-state, mis-attribute, or fabricate any quote, endorsement, or statement from BCA, Alessandro Specchio, or any BCA staff member.
- Do not represent that BCA has certified, vetted, audited, or guaranteed any third party, transaction, or outcome unless we have done so in a written, signed document.
- Do not use BCA branding, logos, screenshots, or domain names in any way that suggests an affiliation that does not exist.
6. Reporting violations
To report suspected violations of this AUP โ abuse, fraud, child-exploitation material, security vulnerabilities, or sanctioned-person activity โ email [email protected] with subject line AUP Report. For child-exploitation material we report to the U.S. National Center for Missing & Exploited Children (NCMEC) and to law enforcement as required by law.
Part B โ Anti-Spam Commitments (about emails we send)
BCA complies with the U.S. CAN-SPAM Act, Canadian CASL, the EU GDPR / ePrivacy Directive, and the UK PECR. We send only the following kinds of email:

How we obtain consent
- Marketing email is sent only if you ticked an opt-in box (we do not pre-tick) or you are an existing customer who received the same category of service and we offered an opt-out at point of sale (PECR / CASL โsoft opt-inโ).
- Consent is recorded with IP, timestamp, page URL, and form snapshot, and retained for 24 months after withdrawal as evidence.
How we honor unsubscribes
- Every marketing email contains a one-click
unsubscribelink in the footer. - Unsubscribes are honored within 10 business days (CAN-SPAM ยง 5(a)(4)) โ we typically process within minutes.
- Unsubscribed addresses go to a suppression list retained indefinitely so we cannot accidentally re-mail you.
- Unsubscribing from marketing does not stop transactional or legally required emails โ those are separate channels.
What we never do
- Buy, rent, scrape, harvest, or trade email lists.
- Disguise the sender โ every email shows a real BCA domain in the
Fromheader. - Use false or misleading subject lines.
- Hide the unsubscribe link or condition it on logging in.
- Sell your email address to third parties.
- Send marketing to addresses on our suppression list.
Reporting spam from BCA
If you received a BCA email you believe violates this Policy, forward the full email with headers to [email protected] with subject line Spam Complaint. We investigate every report within 7 business days, suppress the recipient address, and (if a list-management defect is found) remediate the underlying cause.
Part C โ Acceptable Use of Outbound Messaging by you on BCA-mediated channels
If we provide tooling that lets you send messages to your own contacts (for example, an outbound email feature inside app.bettercallaxel.com), you are the sender and you are responsible for all CAN-SPAM, CASL, GDPR, ePrivacy, TCPA, and equivalent compliance. Specifically you must:
- Have valid, recorded consent (or a recognized legal basis) for every recipient on every list you upload.
- Identify yourself accurately in the
Fromheader โ never use a@bettercallaxel.comsender unless we authorized it in writing. - Honor every recipient unsubscribe within 10 business days at the latest.
- Maintain a suppression list of opt-outs, complaints, and bounces.
- Not message recipients on our platform-wide suppression list (we apply it automatically โ do not attempt to bypass).
We may suspend your sending privileges at any time for high complaint rates, high bounce rates, sender-authentication failures (SPF/DKIM/DMARC), or deliverability harm to other BCA customers โ without refund.
Part D โ Enforcement
- Violations of this AUP are a material breach of the Terms.
- We may, in our sole discretion: warn you, throttle the Service, suspend or terminate your account, freeze associated entities and accounts, withhold deliverables, retain unearned fees as liquidated damages, report you to law enforcement or regulators, and pursue any other remedy available at law or in equity.
- Costs we incur in investigating or responding to a violation (including outside-counsel fees, regulator response, abuse-desk handling) are recoverable from you under Section 12 (Indemnification) of the Terms.
Part E โ Changes
We may update this AUP at any time by posting a new version with an updated effective date. Material changes are announced under Section 18 of the Terms.

Governing Law & Jurisdiction
These terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws principles. The exclusive forum for any dispute shall be the state and federal courts located in Sheridan County, Wyoming, except where applicable consumer-protection law of your country of residence grants you a non-waivable right to a local forum.
